Terms of Service

These Terms of Service (“Terms”) govern your use of the LevUp Works website, workflow automation projects, experiments (including the Missed-call → Text → Booking pattern), SMS program, and related services (together, the “Services”). By using the site, booking time, or engaging LevUp Works for a project, you agree to these Terms.
Who LevUp Works is
LevUp Works is a small, owner-operated studio that designs and implements workflow automation systems for phone-heavy, operations-heavy service and B2B businesses. Services may include experiments, consulting, prototyping, integration work, and ongoing iteration.
Not legal, financial, or compliance advice
LevUp Works helps design and build systems, but does not provide legal, financial, tax, or regulatory advice. You are responsible for understanding any compliance requirements that apply to your business (for example, telemarketing laws, privacy regulations, or industry-specific rules) and for obtaining your own professional advice where needed.
Use of the Services
- You agree to use the Services only for lawful purposes and in a way that does not harm LevUp Works, providers, or other users.
- You will not attempt to disrupt, attack, or reverse engineer systems in ways that violate applicable law or these Terms.
- You will provide accurate information when requested so that workflow automation systems can be set up correctly.
Client responsibilities
If you are a client working with LevUp Works on workflow automations or experiments, you are responsible for:
- Data and consent: ensuring you have a lawful basis and any necessary consents to collect, use, and share information about your customers, callers, and team.
- Third-party tools: complying with the terms of your call providers, CRMs, schedulers, and other tools that LevUp Works connects to as part of the workflow.
- Content and decisions: any content you approve (e.g., SMS or email copy) and any decisions you make based on reports or outputs from the automation.
- Internal processes: how your staff follow up on leads, bookings, or tasks surfaced by the workflow automations.
SMS program
Some workflows and experiments use SMS. These texts are intended to be transactional or relationship messages (for example, about missed calls, bookings, or follow-up), not mass marketing campaigns.
- Purpose: transactional texts about missed calls, booking links, confirmations, reminders, and workflow-related updates.
- Frequency: typically one missed-call message and a small number of follow-up or reminder messages around an appointment, depending on configuration.
- No cold outreach: the SMS program is not intended for cold outreach or bulk promotional campaigns.
- Opt-out: recipients can reply STOP at any time to stop receiving SMS for that workflow.
- Help: recipients can reply HELP for help or email james@levupworks.com.
- Rates: message and data rates may apply, depending on the recipient's mobile plan.
Your callers and users (for clients)
If you are a client using the SMS or automation program for your own customers or callers:
- You are responsible for ensuring you have a lawful basis to contact your callers and users.
- You are responsible for any message content you configure or approve, including compliance with applicable laws and carrier rules.
- You must honour opt-outs from your callers and not attempt to re-add opted-out numbers to SMS flows or other automations.
LevUp Works provides the tooling, configuration, and integration work, but you remain responsible for how you use the Services with your callers and users.
Intellectual property
- LevUp Works retains ownership of its pre-existing tools, code, templates, designs, and know-how.
- You retain ownership of your own data and any brand assets or content you provide for use in workflows.
- Unless otherwise agreed in writing, LevUp Works may reuse general patterns, non-personal learnings, and de-identified structures from projects to improve future workflow automations for other clients, without sharing your confidential information.
Fees and payment
Fees, payment terms, and any milestone or retainer structure will be described in a separate proposal, email, or statement of work. In general, work does not begin until terms are agreed and, where applicable, an initial payment is received.
Disclaimer of warranties
The site and Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory. LevUp Works does not guarantee specific business outcomes, revenue, or performance metrics from any workflow automation or experiment.
Limitation of liability
To the maximum extent permitted by law, LevUp Works is not liable for any indirect, incidental, special, or consequential damages, lost profits, or lost data arising out of or related to your use of the site, SMS program, workflow automations, experiments, or services.
If LevUp Works is found to be liable despite this section, the total liability is limited to the amount you paid LevUp Works for the relevant service in the three (3) months before the event giving rise to the claim.
Termination
LevUp Works may suspend or end your access to the site, workflows, experiments, or services at any time if there is misuse, non-payment, or other material issues. You may stop using the site or services at any time. Sections of these Terms that by their nature should survive termination (for example, intellectual property, limitation of liability, and governing law) will continue to apply.
Governing law
These Terms are governed by the laws of the jurisdiction where LevUp Works is established, without regard to conflict-of-law rules. Any disputes will be handled in the courts of that jurisdiction, unless both sides agree in writing to another forum.
Changes
These Terms may be updated from time to time. The “Last updated” date at the top of this page shows the latest version. If you continue to use the site or services after changes take effect, you accept the updated Terms.
